Mental capacity law develops constantly and there will be many challenges over the coming year, not least of which will be the implementation of the Court of Protection rules, the introduction of Law Society accreditation, developments regarding Deprivation of Liberty and others.
Decisions about best interests continue to require specialist knowledge, crossing over the boundaries between medical and legal practice.
