Survey

PA Consulting (an independent third-party contracted by the MoJ) are undertaking research to provide a robust evidence base for the MOJ’s Review of Civil Legal Aid. They want as many organisations to take place and complete the online survey, which explores civil legal aid providers’ experiences of the sector. Your responses will help shape civil legal aid policy development. 

All survey responses will be anonymous and confidential. On average, the survey takes 20-30* minutes to complete but may take longer depending on the level of detail you provide. Experience from Members who have done this survey suggests the first part is a tick box exercise and can be done quickly, but the second part will take longer as it requests  narrative responses.

Interviews

We are recruiting civil legal aid clients and people who help signpost them to legal aid providers to participate in interviews for the Review. If you are interested in participating in this research or helping to recruit participants, please contact rocla@justice.gov.uk.

About the RoCLA Review

The Ministry of Justice is undertaking a Review of Civil Legal Aid.

The Review is considering the civil legal aid system in its entirety, from how services are procured, how well the current system works for users and providers, and how civil legal aid impacts the wider justice system.

To support policy development, the Review will include 4 analytical workstreams to adopt a comprehensive data-gathering approach:

1.    Economic analysis of the structure of the civil legal aid market

2.    Comparative analysis of systems in other countries

3.    A series of data publications

4.    Social research of user journeys

The Review of Civil Legal Aid will publish reports for all workstreams, releasing evidence papers on this website ahead of the project’s conclusion on 31 March 2024.  Once complete, the government can consider options from the Review for shaping a more effective, efficient, and sustainable system for legal aid providers and the people who rely on legal aid.

Mental Health Solicitor – Southwest & Midlands

The successful candidate will be connected to the southwest and midlands procurement area (office based in Gloucestershire). The candidate does not need to be based within this area however will need to have a willingness to travel to the associated courts or hospitals (based in GL1, GL51, GL53). Job description

  • Meeting and interviewing clients to give advice on all aspects of their detention under the Mental Health Act.
  • Managing varied and complex cases from beginning to end.
  • Representing clients before the Mental Health Tribunal and/or Hospital Managers’ Hearings.
  • Ensuring standards of files are met in accordance with the Office Manual and Lexcel standards.
  • Providing the highest level of client care.
  • Undertaking legal research and instructing experts where required.
  • Undertaking a range of Continuing Competence activities to meet The Law Society’s criteria.
  • Working in a team, sometimes referring cases to the Head of Department.
  • Supervising and delegating work to trainee solicitors, paralegals and legal secretaries as appropriate.
  • Any other duties as directed by the Team Leader or a member of the Management Team.

Person Specification

  • Must be a member of The Law Society’s Mental Health Accreditation Panel.
  • Excellent communicator in both written and spoken English.
  • Excellent understanding of client care requirements and a commitment to legal aid.
  • Proficient in using Microsoft Office package and the ability to learn and efficiently use both practice and case management software.
  • Must be proactive in seeking to manage and progress files and apply a consistent attention to detail.
  • Excellent time management and organisational skills.
  • The ability to work within a high pressure, high workload environment.
  • Be self-confident, proactive and able to develop good working relationship with third parties.
  • Resilient with the ability to cope with ever-changing priorities.
  • A flexible approach and willingness to help across the department, with a “can do” attitude.
